Terms of Use

3.1 Account Creation

To use certain features of our Service, you must create an account by providing:

You may also register using third-party authentication services (e.g., Google, Discord) if available.

3.2 Eligibility

You must be at least 13 years of age to use our Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. Users between 13 and 18 years of age must have parental consent.

3.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of information provided during registration
• Notifying us immediately of any unauthorized use of your account

3.4 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in prohibited activities as outlined in Section 5.

4.1 Free Plan

Our Free Plan provides:

• Access to free templates
• Access to free design elements
• Access to free design backgrounds
• Access to free design frames
• Limited access to premium features (with watermarks)

4.2 Premium Subscription Plans

We offer the following subscription plans (prices in Indian Rupees, INR):

• 1 Month Plan: ₹500 - Duration: 30 days from activation date. Ideal for monthly projects and flexible billing
• 6 Months Plan: ₹2,000 - Duration: 180 days from activation date. Best for long-term creators with significant savings compared to monthly billing
• 1 Year Plan: ₹3,500 - Duration: 365 days from activation date. Maximum value for professionals with the best savings and longest access period

Note: All subscription durations are fixed periods that begin immediately upon payment confirmation. Subscriptions do not auto-renew and must be manually renewed upon expiration.

4.3 Premium Features

Premium subscription plans include full access to all features:

• Access to all templates including premium templates categorized by country, language, religion, theme, size, and style
• Access to all design elements, icons, graphics, and decorative assets
• Access to all design frames in the frames library
• Access to all design backgrounds and background patterns
• Access to all premium shapes and shape customization options
• Ability to save designs as templates for future use and sharing
• Unlimited access to paid templates during subscription period
• Watermark removal on exported designs (PNG, JPG, JPEG, PDF formats)
• AI background remover functionality with unlimited usage (subject to rate limits)
• Ad-free experience throughout the platform
• 24/7 Customer Support with priority response
• Priority access to new features, templates, and design assets
• Unlimited project creation and storage
• Unlimited image uploads and storage
• Full access to all export formats and options

4.4 Individual Template Purchases

In addition to subscription plans, you may purchase individual premium templates on a per-template basis:

• Templates are priced individually as displayed on the platform (prices in Indian Rupees, INR)
• Individual template purchases provide access to that specific template for 5 days (120 hours) from the date and time of successful payment confirmation
• Payment is required upfront for individual template purchases through Razorpay
• During the 5-day access period, you can use, edit, and export the purchased template without limitations
• After the 5-day period expires, access to the template will be restricted unless you purchase a subscription or repurchase the template
• Template purchase history is maintained in your account for reference

4.5 Payment Processing

All payments are processed securely through Razorpay, a PCI-DSS compliant payment processor. All prices are displayed in Indian Rupees (INR). We do not store your full payment card or bank account details on our servers - all sensitive payment information is handled directly by Razorpay. Payments are processed using industry-standard encryption and security measures. By initiating a purchase, you authorize us to process payment through Razorpay for the selected subscription plan or template purchase.

4.6 Subscription Duration and Cancellation

Subscriptions are for fixed duration periods and do not auto-renew. Subscriptions cannot be cancelled mid-term for partial refunds. You will lose access to premium features upon expiration of your subscription. To continue using premium features after expiration, you may purchase a new subscription at any time.

4.7 Refund Policy

Subscription fees are non-refundable except as required by applicable law or at our sole discretion in exceptional circumstances. Individual template purchases are non-refundable once access is granted. If you believe you are entitled to a refund, please contact our customer support team.

4.8 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect active subscriptions but will apply to new purchases.

5.1 Your Content

You retain all ownership rights to designs, images, and other content you create or upload to our Service ("User Content"). By using our Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Store, host, and display your User Content on our Service
• Process and transform your User Content to provide our services
• Create backups of your User Content

5.2 Our Content and Templates

All templates, design elements, frames, backgrounds, shapes, and other design assets provided by Canvelop ("Platform Content") are owned by Canvelop or our licensors. Platform Content is licensed to you under these Terms, not sold.

Your license to use Platform Content is limited to:

• Creating derivative works (your designs) using Platform Content
• Exporting and using your final designs for personal or commercial purposes
• You may NOT redistribute, resell, or share Platform Content in its original form
• You may NOT use Platform Content to create competing template libraries or services
• You may NOT remove watermarks or attribution from Platform Content without a valid subscription

5.3 User-Generated Template Sharing

If you save your design as a template and choose to share it, you grant other users the right to use that template for their own designs, subject to these Terms.

6.1 Permitted Uses

You may use our Service to:

• Create original designs for personal or commercial use using our design editor and tools
• Edit and customize templates (free and premium) for your projects
• Export your designs in supported formats (PNG, JPG, JPEG, PDF, ZIP) with appropriate quality settings
• Upload and use your own images and content in your designs
• Save and manage unlimited design projects with automatic saving functionality
• Generate QR codes for URLs, text, contact information, or other data with customizable styling
• Use AI-powered features such as background removal and image processing (subject to rate limits)
• Apply image filters and effects (polaroid, sepia, vintage, blur, sharpen, greyscale, brownie, kodachrome, technicolor, pixelate, invert, emboss, removecolor, blacknwhite, vibrance, blendcolor, huerotate, saturation, gamma, noise, grainy, cool-tone, warm-tone, and more) to your designs
• Create multi-page design projects with multiple pages and layouts
• Use drawing tools to create custom illustrations and freehand designs
• Use shape tools to add geometric shapes, arrows, lines, polygons, and custom shapes
• Add and edit text with various fonts, styles, and multi-language support
• Manage canvas settings including zoom, pan, layers, grouping, alignment, and transformations
• Set and manage backgrounds with history and undo/redo functionality
• Save your designs as templates for future use (premium feature)
• Purchase individual templates or subscription plans for premium access

6.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload, create, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, discriminatory, hateful, pornographic, obscene, or contains viruses or malware
• Use automated systems (bots, scrapers, etc.) to access our Service without permission
• Attempt to reverse engineer, decompile, or extract source code from our Service
• Interfere with or disrupt the Service or servers
• Create multiple accounts to circumvent restrictions or access limits
• Share your account credentials with others
• Use the Service for any unauthorized commercial purposes

6.3 Rate Limiting

To ensure fair usage and service stability:

• Logged-in users: Limited to 100 requests per minute
• Anonymous users: Limited to 20 requests per minute
• AI endpoints (background removal, etc.): Limited to 5 requests per minute
• We reserve the right to adjust these limits as needed

6.4 Enforcement

Violation of these Terms may result in immediate suspension or termination of your account, removal of prohibited content, legal action if necessary, or reporting to appropriate authorities for illegal activities.

7.1 AI-Powered Features

Our Service includes AI-powered features that enhance your design capabilities:

• Background Removal: AI-powered automatic background removal from images using advanced image processing algorithms. This feature analyzes images and intelligently separates foreground objects from backgrounds
• Image Processing: Intelligent image enhancement, optimization, transformation, and processing capabilities powered by AI technology to improve image quality and usability
• Processing Details: AI processing occurs on our servers and may take time depending on server load, image complexity, image size, and current system demand. Processing times can range from a few seconds to several minutes

Important Notes:

• We do not guarantee perfect results from AI features - results may vary based on image quality, complexity, and content
• AI processing is subject to rate limiting as described in Section 6.3 to ensure fair usage and system stability
• AI-processed content remains your property, but you are responsible for ensuring the processed content complies with these Terms and applicable laws
• We are not liable for any issues arising from AI-generated or processed content, including but not limited to accuracy, quality, or legal compliance

7.2 AI-Generated and Processed Content

Content processed or generated through our AI features remains your property. You are responsible for ensuring AI-generated or processed content complies with these Terms and applicable laws. We are not liable for any issues arising from AI-generated or processed content, including but not limited to accuracy, quality, or legal compliance of the processed content.

7.3 QR Code Generation

Our Service includes a QR Code Generator tool that allows you to create customizable QR codes. You are responsible for the content encoded in QR codes and ensuring such content complies with applicable laws and regulations. We are not responsible for the accuracy, functionality, or legality of the content encoded in QR codes you create.

8.1 Data Storage

We store your projects, uploaded images, saved templates, and account information on our servers. Projects are stored in a compressed format to optimize storage. We use industry-standard security measures to protect your data.

8.2 Data Retention

Your projects and uploaded content are retained as long as your account is active. Upon account deletion, all associated data (projects, images, saved templates) will be permanently deleted within 30 days. Some data may be retained longer if required by law or for legitimate business purposes (e.g., payment records).

8.3 Backup and Availability

While we make reasonable efforts to maintain data availability, we do not guarantee that your data will always be accessible. You are responsible for maintaining your own backups of important designs. We recommend exporting and saving your designs locally.

9.1 Export Formats

Our Service supports exporting designs in the following formats:

• PNG (Portable Network Graphics) - High-quality raster format with transparency support
• JPG/JPEG (Joint Photographic Experts Group) - Compressed image format for smaller file sizes
• PDF (Portable Document Format) - Vector-based format suitable for printing and sharing
• ZIP Archives - Download all design objects as a compressed archive for easy sharing and backup

QR codes generated through our QR Code Generator can be exported in PNG, SVG, PDF, and JPG formats.

9.2 Export Rights

You may export and download your designs without limitation. Exported designs are yours to use for any lawful purpose. Free plan users may have watermarks on exported designs. Premium subscribers can export designs without watermarks.

9.3 Download Responsibility

You are responsible for ensuring your use of exported designs complies with applicable laws. We are not responsible for how you use exported designs outside our platform.

11.1 Service Availability

We strive to provide continuous availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or unforeseen circumstances. We are not liable for any losses resulting from service unavailability.

11.2 Service Modifications

We reserve the right to:

• Modify, update, or discontinue features at any time
• Change subscription plans, pricing, or features
• Add or remove templates, assets, or functionality
• Implement new policies or restrictions

11.3 Updates and Notifications

We will notify users of significant changes to the Service or these Terms. Continued use after changes constitutes acceptance of modified Terms. Major changes will be communicated via email or platform notifications.

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF CONTENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANVELOP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, SERVICE INTERRUPTIONS OR UNAVAILABILITY, ERRORS OR INACCURACIES IN CONTENT, OR UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.3 Third-Party Services

Our Service may integrate with third-party services (e.g., Google, Discord, Razorpay). We are not responsible for third-party service availability or practices. Your use of third-party services is subject to their respective terms and policies.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution Process

In the event of a dispute:

1. Contact our customer support team first to attempt resolution
2. If unresolved, disputes may be resolved through mediation (if mutually agreed), arbitration (if required by applicable law), or courts of competent jurisdiction in Surat, Gujarat, India

14.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action, except where prohibited by law.

15.1 Modification Rights

We reserve the right to modify these Terms at any time. Material changes will be posted on our website, communicated via email to registered users, and effective 30 days after notification (or immediately for non-material changes).

15.2 Acceptance of Changes

Continued use of the Service after changes constitutes acceptance. If you do not agree to changes, you must stop using the Service and may delete your account. Your only remedy is to discontinue use of the Service.

16.1 Termination by You

You may terminate your account at any time by contacting customer support, using account deletion features in your account settings, or stopping use of the Service.

16.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in prohibited activities
• Fail to pay required fees
• Request account deletion

16.3 Effect of Termination

Upon termination, your access to the Service will cease immediately. Your account and associated data will be scheduled for deletion (within 30 days). All licenses granted to you will terminate. You remain responsible for fees incurred before termination. Provisions that should survive termination (e.g., indemnification, disclaimers) will continue.

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canvelop regarding the Service.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

17.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet failures.

17.6 Language

These Terms are provided in English. If translated, the English version shall prevail in case of conflicts.

18.1 Subscription Periods

Subscription periods are fixed and begin immediately upon payment confirmation. Subscriptions are non-transferable. Subscriptions are for individual use unless otherwise specified.

18.2 Access During Subscription

Premium features are available only during active subscription periods. Access to previously used premium templates may be restricted after subscription expiration. Saved projects remain accessible but may lose premium features (e.g., watermarks may be added).

18.3 Template Access Expiration

Individual template purchases: Access valid for 5 days from purchase date. Subscription templates: Access valid for the duration of your active subscription. After expiration, you must purchase a new subscription or repurchase templates to regain access.

19.1 User Roles

Our platform includes different user roles:

• Regular Users: Standard access as described in these Terms
• Moderators: Enhanced access with moderation capabilities (exempt from certain rate limits)
• Administrators: Full system access (exempt from rate limits)

19.2 Role Assignment

Roles are assigned at our discretion. Role changes may affect your access and permissions. We reserve the right to modify or revoke role assignments.
